Background

35 years of gaming law experience. Former member of the Nevada Gaming Control Board and a leader in handling complex gaming and compliance matters. Operates at the juncture of legal, regulatory and business.  

Scott Scherer uses a unique mix of regulatory, business, policy and legal perspectives to help clients implementing new technologies and systems in the gaming industry, including for payments, sports betting and online gaming. Clients rely on him to steer them through the hurdles they face getting regulatory approval, obtaining licensing and ensuring compliance. Involved in the evolution of the gaming industry on both a national and international level for the last three decades, Scott applies his deep historical understanding of both the business and regulatory issues to help his clients get their new technologies to market. Clients rely on his insight to ensure alignment with compliance requirements as they seek regulatory approvals or move into new jurisdictions. 

Scott’s understanding of national and international business as well as regulatory and compliance matters comes from significant roles in the gaming industry. In addition to his position on the Nevada Gaming Control Board, Scott served as in-house counsel for a major gaming device manufacturer—where he also served for a time as managing director of an international subsidiary. In addition to his private sector clients, he also advised and assisted various governments in drafting gaming laws and regulations. This diverse experience provides Scott the unique knowledge and insight to offer top tier legal counsel to his clients in the gaming industry. 

Scott also represents clients on other state licensing and regulatory matters, including matters in front of the Nevada Transportation Authority and represents clients with regard to state and local tax matters.

Representative Matters

Licensing and Compliance

  • Successfully represented clients in various disciplinary matters which are not public because they have been resolved without the filing of a formal complaint for disciplinary action.

  • Serve as counsel to the compliance committees of two gaming device manufacturers licensed in multiple jurisdictions.

  • Serve as counsel to the Compliance Committee for a major international casino company.

  • Serve as the Chair of the Compliance Committee for an International gaming company.

  • Successfully represented William Hill with regard to licensing at race books and sports pools previously operated by Caesars and CG Technologies, including analysis of multiple licensing criteria to satisfy Nevada regulators.

Payments, Technology, Social Gaming and Sports Betting

  • Represented Marker Trax with regard to the initial approval of its system in Nevada.

  • Prepared compliance training materials for various licensed gaming companies.

  • Prepared 50-state surveys on laws and litigation risks related to social gaming.

  • Represent various payment providers with regard to licensing and approval of their technology for use in the gaming industry.

Expert Testimony, Due Diligence and Legal Opinions

  • Serves as both a consulting and testifying expert in various matters domestically and internationally with regard to gaming regulatory issues.

  • Represented various companies in conducting due diligence and ensuring appropriate gaming regulatory requirements are met in transactional matters in the gaming industry.

  • Prepared numerous legal opinions to satisfy the “safe harbor” requirements of regulations adopted under the Unlawful Internet Gambling Enforcement Act.
